Terms of Service 

When booking any service or consultation with Sleeping Sprogs, the Client agrees to these Terms of Service:

In these Terms of Service 'we', 'us' and 'our' refers to "Sleeping Sprogs".

“Client” refers to any person or body corporate engaging with Sleeping Sprogs for their services or resources as outlined in these Terms of Service.

General

The Client agrees to follow all safe sleep practices in line with SIDS recommendations.

The Client fully understands the safety guidelines on co-sleeping and accepts that Sleeping Sprogs strictly follows safe sleeping practise which supports room-sharing, not bed-sharing. 

The Client will disclose any medical and health conditions that their child has to Sleeping Sprogs, including known allergies and any medication their child takes.

The Client acknowledges and accepts that any information, guide, resource or any part of any information, guide or resource may not be copied, reproduced, re-purposed, distributed, shared or re-used in any manner, electronically or otherwise, without the explicit written permission of Sleeping Sprogs.

Client Acknowledgement​

The information provided in the sleep intake form is as accurate as possible to the Client’s knowledge.

If the Client’s child has a medical or health condition, my health care provider’s approval has been sought before commencing a sleep plan.

The Client acknowledges it is the Client’s responsibility to rule out any possible medical causes of sleep problems of their child and to then determine if it is suitable to commence or continue on with sleep support changes.

The Client acknowledges it is the Client’s responsibility to ensure their child is gaining weight appropriately, healthy and is otherwise well before commencing or continuing on with sleep support changes.

The Client acknowledges that Sleeping Sprogs is not able to give medical advice or answer any questions that I have regarding my child’s health.

The client acknowledges the information received from Sleeping Sprogs is not a substitute for professional medical advice, diagnosis, or treatment. 

The Client acknowledges they must always seek the advice of a qualified health practitioner with any questions or concerns they have in regard to the health of their child.

The Client acknowledges that Sleeping Sprogs will not be responsible nor liable in the event of any injury or adverse events occurring while undertaking sleep support. The Client is responsible for the safety and health of their child at all times.

The Sleeping Sprogs website may contain links to other websites that are owned and operated by other parties (the "External Sites"). You acknowledge that Sleeping Sprogs is not responsible for any part of the content located on or through, any External Site.  

Payment

Full payment for all packages and follow-up support is required prior to sleep support starting. Once payment is received in full the Client will receive acknowledgment of payment by Sleeping Sprogs. Phone consultations will be confirmed once payment has been made.

Package prices include GST.

Sleeping Sprogs reserve the right to alter prices at any time for any reason. 

No sleep plan, resource or guide will be issued nor will a consultation take place without full payment received. 

Sleeping Sprogs reserves the right to cancel a consultation if there is an outstanding balance owing at the time of the scheduled consultation.

Any outstanding debt to Sleeping Sprogs will be referred to debt collection agencies.

Payment is to be made in full via the website, using a secure Stripe payment system. 

At the discretion of Sleeping Sprogs a Client may request payment of any service (excludes resources and guides) to be paid in 4 x weekly installments. The service will not commence until the service has been fully paid.

Tailored Sleep Plan and One Off Consult Service

Full payment is required before the service will commence.

Once payment is made, there will be no refunds.

There are no refunds if the client has a change of mind about the sleep support service (see Cancellations below)

There is no follow-up support included in this service. 

Anytime within 2 months of the phone consultation, clients are able to upgrade and purchase 2 weeks of one on one support if they need further support and guidance from Sleeping Sprogs (subject to availability).

The service price includes GST.

Sleeping Sprogs reserves the right to alter prices at any time for any reason.​

​Conditions of a Sleep Plan & Sleep Support

Individual results may vary and results depend on many matters; including but not limited to, consistency, commitment, personal matters, approach to settling techniques, techniques or methods, the child’s needs, the child’s age and developmental stage, severity of situation, following the plan correctly, communication to Sleeping Sprogs and the parents’ desire for change.

A refund is not offered in the event of the client feeling dissatisfied and the client understands that by embarking the plan that this is a risk taken.

Most clients will see results within 10-14 days with consistency, commitment and communication with Sleeping Sprogs.

Sleeping Sprogs is obligated to keep up to date with current information, research and knowledge surrounding child’s sleep.

The Client understands that the customised sleep plan is meant for their child and only, and should not be shared with a third party. They acknowledge the information might not be suitable for another child which includes siblings.

Any changes the Client makes to their child's sleeping or eating arrangements are their decision and Sleeping Sprogs will only make suggestions for change, of which the Client is responsible for choosing to implement.

It is the Client's responsibility to contact Sleeping Sprogs for any follow up and send the sleep log information through to be assessed for feedback as frequently as suggested.

Upon purchase of a sleep package the Client is agreeing to these terms and conditions and privacy policy as outlined.

​​In-Home Support

​For clients that are considering booking in-home support or have booked in-support, the Consultant will contact you via email within 48 hours of booking the service. 

Following this the Consultant will complete a phone consult with you. It is during this consult we will agree and plan for when the in-home support will commence. Consultants are typically available to attend the home consult within 5-10 working days of the 15 minute consult (subject to availability).

The Client is responsible for informing the Consultant who will be in the home during the in-home support and their relationship to the Client. If the Consultant arrives at the home and does not feel it is appropriate or safe to enter the home, the in-home consultation will be rescheduled if the Consultant deems it safe to do so.

If at any time during the in-home consultation the Consultant doesn't feel it is appropriate to stay due to safety concerns; the in-home consultation will be concluded and rescheduling of the remaining in-home consultation will not be provided.

Refunds are not available for in-home support packages.

Travel costs are included in the package price (travel within 30 kilometers of Hastings). If the in-home consultation is to take place at an address outside of travel area there will be an additional fee of 83c per kilometre. This will be charged and invoiced prior to the in-home consultation. Payment is to be made in full prior to the commencement of the package.

If the in-home consultation is to take place at a location that requires travel by airfare, the Client will be charged and invoiced prior to the in-home consultation. Payment is to be made in full prior to the commencement of the package.

Cancellations

Cancellations made more than 10 working days prior to a consultation will receive a full refund, less transaction fees.

Cancellations made less than 10 working days prior to a consultation are not eligible for a refund. 

In the occurrence of sickness or critical events, Sleeping Sprogs can reschedule the consultation and cater accordingly at the discretion of Sleeping Sprogs.

Once the sleep plan has been received or a consultation has taken place, there will be no refund offered for change of mind.

If a support package is postponed for reasons agreed up by the Client and Sleeping Sprogs they forfeit the eligibility for a refund as above, from the rescheduled support start date (unless medically unwell).

If a support package is canceled due to medical reasons and the Client has received the sleep plan their sleep support will be postponed to a date agreed upon by both parties.

Sleeping Sprogs reserves the right to cancel any package prior to the commencement of the home or phone consultation if they deem the package inappropriate for the Client. An alternative package may be suggested and the price difference refunded or the full amount refunded if Sleeping Sprogs or the Client chooses to forfeit the service entirely. 

Disclaimer

​Sleeping Sprogs adhere to and follows all of the safe sleeping guidelines.

Sleeping Sprogs does not offer any medical advice, services or treatment to any client.  If you have concerns relating to a medical or nutritional issue the client should contact their GP or pediatrician immediately.

Sleeping Sprogs is fully covered with IICT insurance.

The client acknowledges any changes to their baby's sleep or eating arrangements that may be suggested are at their discretion, of which they are responsible for choosing to implement.

The information provided by Sleeping Sprogs on any platform (website, social media, in person or in documentation) is not intended nor is implied to be a substitute for professional medical advice.  

The Client must always seek the advice of a GP or other qualified healthcare provider with any questions regarding a medical condition or the health and welfare of their baby, toddler or child.​

Sleeping Sprogs will use all reasonable efforts to include up-to-date and accurate information during consultations and on this website, but makes no guarantee of the information provided. ​

Sleeping Sprogs shall not be liable for any loss or damages (including direct or indirect loss, or special or consequential loss) resulting from the Client's access to, or inability to access, this website, or from the Client's reliance on any information provided on this website or by the consultant.

Sleeping Sprogs owns all content on this website and the materials, texts, advice, guidance, manuals, and technical information provided to you. The Client may download content only for their personal use for non-commercial purposes, but no modification or further reproduction of the content is permitted.  The content may not be copied or used in any way without express written permission of Sleeping Sprogs.

​All materials are provided for non-commercial personal use only.  The Client agrees that they will not copy, distribute or adapt the content for any other use.

​Sleeping Sprogs maintains this site for your personal information, education and communication.  Please feel free to browse the site.  The Client and any visitor to this website may download material displayed on the website for personal, non-commercial use.  

You may not be copied, reproduced, re-purposed, distributed, shared or re-used in any manner, electronically or otherwise, or use the content of the site for public or commercial purposes, including the text, images, audio, and video without the explicit written permission of Sleeping Sprogs.

Confidentiality and Privacy Policy 

The Client acknowledges that Sleeping Sprogs will uphold their case in confidentiality.

The Client confirms that they will not share their child’s sleep plan or its content with any third party without Sleeping Sprogs permission to do so. 

Information we collect

Sleeping Sprogs will collect typical personal information including name, address, phone number, email address.

Sleeping Sprogs will use the Client's personal information to create an online registration, to record and process their package for general communication. Sleeping Sprogs does not share this personal information to third parties.

Emailing tools

Sleeping Sprogs will communicate with the Client by email and may send them Newsletters, informative communication and other marketing information.

Control of your online credentials

If the Client has registered online, they are responsible for all actions taken with their username, email address and password. If they choose to share their user name, email address and password or their information with third parties, they are responsible for all actions taken with this information and therefore the Client should review that third party's privacy policy.

Cookies

Cookies are small pieces of information that are stored in a browser-related file on the Clients computer's hard drive when they use our website. We use cookies to improve the user experience. Cookies are widely used on most major websites. Sleeping Sprogs mostly use "session" cookies, which are removed from the Clients computer after they leave Sleeping Sprogs. A second cookie is placed on their computer (if they choose) for Sleeping Sprogs to remember them, this cookie is intended to remain until deleted. These are used so our website can remember that they have logged in already and prevent them doing so more frequently. Wix uses cookies for important reasons, such as: To provide a great experience for our visitors and customers. To identify our registered members (users who registered to our site). To monitor and analyze the performance, operation and effectiveness of Wix's platform.

Providing information

The Client agrees that Sleeping Sprogs may provide any personal information it collects about them to its related companies (as defined in section 2(3) of the Companies Act 1993), debt collection and credit reference agencies and any other parties it deems necessary in relation to providing them access to this website, for any services from Sleeping Sprogs, to recover any money they owe to Sleeping Sprogs and to exercise any lawful right Sleeping Sprogs, its related companies or debt collection and credit reference agencies may have. The Client also authorizes any person to provide Sleeping Sprogs with such information as Sleeping Sprogs may require in response to credit enquiries.

Membership removal

If the Client wishes to have their registration removed from our directory for any reason, simply send us an email requesting to be removed - sleepingsprogs@gmail.com

Severability

If any provision of this Privacy Policy is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from this Privacy Policy and the remaining provisions shall continue in full force.

Access and removal of information

The Client has the right to access, change and delete personal information that Sleeping Sprogs holds about them. They can exercise this right at any time by emailing sleepingsprogs@gmail.com. From time to time, we make changes to our information practices or alter the functionality of our website.
